1. Acceptance of Terms and Conditions

The present general conditions of sale govern the contractual relations between you and MAISON HALLEUX SPRL, both parties accepting them without reserve. These general conditions of sale will prevail over any other conditions appearing in any other document, except prior, express and written derogation.

You acknowledge that you have read them at the time of placing your order and expressly declare that you accept them without reserve. The validation of your order is thus worth acceptance of these general conditions of sale.

2. Products

Photographs illustrating the products, do not enter into the contractual field. If errors are introduced, the responsibility of MAISON HALLEUX SPRL, cannot be engaged.

3. Order

The automatic recording systems are considered as proof of the nature, content and date of the order.

MAISON HALLEUX SPRL, confirms the acceptance of your order to the email address that you will have communicated. The sale will only be concluded as of the confirmation of your order and the reception of the complete payment. 

MAISON HALLEUX SPRL, reserves the right to refuse or cancel any order from a customer with whom there is a dispute concerning the payment of a previous order.

The information stated by the purchaser, at the time of the order taking, commits him: in case of error in the wording of the coordinates of the recipient, the salesman could not be held responsible for the impossibility in which it could be to deliver the product.

4. Delivery

Delivery is made by post or carrier depending on the country of destination, and according to the choice expressed by the customer.

In case of apparent defects, you have a right of return under the conditions set out in Article 6.

Are considered as force majeure discharging the seller from its obligation to deliver, war, riots, fire, strikes, accidents and the impossibility to be supplied in case of stock shortage.

The goods always travel at the recipient's risk. Always check your package upon arrival. You have a period of 3 days for a delivery in Belgium and 7 days for a delivery in Europe, to make possible reserves with the carrier in case of missing or damaged goods.

5. Transport

5.1 The shipping costs are calculated at the actual price, without any margin to the benefit of BALMOGEST SPRL. All shipments abroad are carried out by carrier, parcel, road, sea, air groupage. For all shipments you will receive a transport number.

For customers who have received free transport. Having problems with this method of ordering customers who do not receive their order or do not pick it up at the pick-up of their choice, we are obliged to withhold a fee of € 3.00 for the preparation of the order, the transport which we have taken care of and offered free of charge at the departure. We advise customers to track their order with the tracking number we send at the beginning of the order. The deadlines are mentioned according to the choice of the carrier.

5.2 For the most common destinations, several delivery times are proposed to you, at different rates. The times indicated for shipments by carrier are guaranteed while the times announced for shipments by post are given as an indication.

5.3 The price of transport is calculated according to the weight of your order. It will be sent to you by e-mail after your order is closed. However, if the price of transport does not suit you, we will close the sale by refunding your purchases. We will use the same method of payment that you would have used.

5.4 Transport times 

The shipping times announced (see your order form) apply from the moment the order has been transmitted to the carrier of your choice.  Weekends and holidays must be added to the announced transport times.

6. Product Compliance

6.1 We undertake to reimburse you or to exchange you for defective, damaged or damaged products or products that do not correspond to your order. In this case, we thank you to report it in detail in writing and return the product(s) concerned. The company BALMOGEST SPRL will proceed, at your choice, to the exchange or refund of the product(s) and to the reimbursement of the shipping costs for the return. The request must be made within fifteen working days following delivery to the address below. Any claim made outside this period will not be accepted.

7. Withdrawal 

In application of the European Community texts applicable to distance selling, you have 7 days from receipt of the items to return the product that does not suit you. 

In case of exchange or refund, you must return the new item in its original packaging, intact, accompanied by all accessories, manuals and documentation to the following address:

The right of return does not apply to audio and video recordings.

In case of exercise of the right of retraction, MAISON HALLEUX SPRL will reimburse you the sums paid, free of charge, with the exception of shipping costs. Reimbursement will be made within a maximum period of 30 days.

8. Price

All prices are quoted in Euro.

The price mentioned on the product sheets does not include transport.

The prices indicated on your order confirmation include the price of the products, the handling, packaging and transport costs of the products.

9. Payment

All orders, whatever their origin, are payable in Euro.

The price invoiced is the one indicated on your order confirmation. The price of the products is payable in cash on the day of the effective order.

Payment is made by credit card:

1/ - On line: by means of the secure payment system or bank transfer of MAISON HALLEUX.

With the secured payment, the security of the transactions is treated on all the Internet chain: bank, merchant, SSL encryption and security of the servers. We have chosen one of the most reliable secure systems available on the Internet, which allows to protect and encrypt all your personal information.

Schedules are subject to change depending on the time of year. The company closes from December 23rd for 12 to 15 days.

Your validated order will only be considered effective when we have received the payment made with the payment method that will be proposed to you.

In case of non-payment, your order will be automatically cancelled and you will be notified by email.

The payment can then be made : 

- by credit card (credit card number and validity date are mandatory as well as the last 3 digits of the number written on the back of the card) 

- by bank at the number provided at the closing of your basket. 

- PayPal payment fees for small amounts may be added to your order.

10. Protection of your personal information

The nominal information concerning you is indispensable for the treatment and routing of orders and the establishment of invoices. In the absence of this information, the order cannot be validated and honored.

In accordance with the French Data Protection Act of 6 January 1978, the processing of personal information relating to customers has been declared to the Commission Nationale de l'Informatique et des Libertés (CNIL). You have (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of data concerning you. 

11. Litigation

This contract is subject to French law.

MAISON HALLEUX SPRL cannot be held responsible for damages of any kind, whether material, immaterial or corporal, which could result from a malfunction or misuse of the products marketed.

It is the same for the possible modifications of the products resulting from the manufacturers.

The responsibility of MAISON HALLEUX SPRL will, in any case, be limited to the amount of the order and will not be held liable for simple errors or omissions which could have remained despite all the precautions taken in the presentation of the products.

Complaints or contestations will always be received with benevolence, good faith being always presumed in those who take the trouble to expose their problem. 

In case of dispute, the customer will address in priority to de MAISON HALLEUX SPRL - to obtain an amicable solution.

It is reminded that the search for an amicable solution does not interrupt the short period of the legal guarantee, nor the duration of the contractual guarantee. As a general rule and subject to the appreciation of the Courts, the respect of the provisions of this contract relating to the contractual guarantee supposes :

- that the purchaser honors its financial commitments towards the seller 

- that the purchaser uses the purchased items in a normal manner.

In the absence of an amicable solution, the Commercial Court of cork is the only competent court, whatever the place of delivery and the method of payment accepted.

12. Guarantee

In any case, you benefit from the legal guarantee relating to hidden defects. 

On the condition that you have proven the hidden defect, MAISON HALLEUX must legally repair all the consequences of it.

13. Intellectual Property

All the texts, comments, works, logos and images presented on the MAISON HALLEUX SPRL. website are reserved, for the whole world, under copyright and intellectual property. Any total or partial reproduction of the catalog of MAISON HALLEUX SPRL - is forbidden. The articles cannot be copied or reproduced.

14. A policy respectful of our customers

Preserving your privacy is very important. This is why MAISON HALLEUX SPRL undertakes never to communicate your details to third parties. The information you entrust to us will therefore remain confidential.

MAISON HALLEUX SPRL uses the technique of cookies, the information thus collected will facilitate your use of the site, avoiding in particular multiple re-entries. They allow us, moreover, to better know your purchasing habits in order to better serve you. 

- Your address is useful to us at the time of the order to send you your invoice and your order within the deadlines.

- Your mail address allows us to confirm your order, and to contact you if necessary.

Warning

Unfortunately, we are obliged to protect ourselves against possible indelicate behaviour. To this end, we have put in place the following measures: 

- During transactions, we record your IP address, as well as the exact dates and times of the transactions. This unique and formal identification confirms your contractual commitment. 

- Any attempt at fraud, whatever the amount or origin, will be subject to legal proceedings.
